2022 International Conference
Thursday morning, we will kick off a full day simulation that covers 10 of the most pressing, and in some cases newest, topics facing professionals who deal with assets or creditors from abroad.
The simulation begins with a Cayman hedge fund being unable to meet its debt obligations and being put into liquidation. As our intrepid offshore liquidator friends look into the business, they find hundreds of millions of dollars of investments have been used to purchase positions in debt, equity, or a combination of operating companies in a number of nations including the United States. Looking for ways to exert control over these investments, they conclude that in many cases a US based receiver motion is the best remedy to secure their positions.
As an attendee, you will play a role as a “Cayman Liquidator,” “US Receiver,” “Fraudster,” “IRS agent,” among other roles to work with your group on solving first day matters, COMI disputes, protocols with foreign practitioners, the effect of Covid on expectations, tax issues both in the US and abroad, professional fees, distribution priorities, and final order protections both at home and abroad.
We look forward to seeing bombastic attorneys debating their respective positions, difficult choices being made as receivers balance competing constituencies, and perhaps an unexpected ruling or two from the bench that throws the best laid plans awry.
